  4. In the class action suit against Dapper Labs (creators of CryptoKitties) alleging the NBA Top Shot Moments NFTs are securities, the court has denied the motion to dismiss. This is just the court saying that if all the factual allegations are taken as true, then there is a plausible claim for relief. This is not a ruling on the status of NFTs as securities or not.
